Representations/Warranties 

By participating in ClassOne’s Pet Walk and Fundraiser Event(the “Event”), you represent, warrant, and agree that you are and will remain in compliance with all applicable laws, including the Pennsylvania Dog Law, 3 P.S. §459-101, et seq. and Hempfield Township Ord. No. 56-1, Section 37. You represent and warrant that your participating pets are up to date on required vaccinations and will be leashed or otherwise under your supervision and control at all times. Participants with dogs additionally represent and warrant that their dog is not a Dangerous dog as defined by the Dog Law and has a valid PA Dog License. Any participant found to be in breach of these representations and warranties or any applicable laws will be asked to leave the Event without a refund and may be subject to other fines and penalties pursuant to applicable law. The event organizers reserve the right to refuse participation in the event or to ask you to leave in the best interests of the Event and other participants.

Liability Waiver 

You agree to expressly waive and release any and all claims, now known or hereafter known, against the Event organizers, officers, and employees of ClassONE Property Restoration on account of injury, disability, death, or property damage arising out of or attributable to your participation in the Event, whether arising out of the ordinary negligence of the Event organizers or arising out of or related to: (a) any negligent or more culpable act or omission of a third party; (b) any bodily injury, death of any person, or damage to real or tangible property caused by the negligent or more culpable acts or omissions of a third party; or (c) any failure by any third party to comply with any applicable federal, state, or local laws, regulations, or codes in connection with this Event.

Indemnification 

You further agree to indemnify, hold harmless, and defend the Event organizers and officers and employees of ClassONE Property Restoration (the “Indemnified Parties”) against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney’s fees, that are incurred by the Indemnified Parties, arising out of or related to any third-party claim alleging: (a) a negligent or more culpable act or omission by you in connection with attendance at or participation in this Event; (b) any bodily injury, death of any person, or damage to real or tangible property caused by yournegligent or more culpable acts or omissions; or (c) your failure to comply with any applicable federal, state, or local laws, regulations, or codes while in attendance at or participation in the Event.
